Do you know your MCA from your DoLS?

Are your staff aware of section 44 of the MCA and how it affects them and your dervice?

The Mental Capacity Act was introduced to help protect some of the most vulnerable people in our society. It was implemented after the Bournewood case and is a a major piece of legislation to ensure that when deciding that someone lacks capacity that all efforts have been accuratly made to allow the person full control and independence in their choices unless their is a need for a best interest decision.

The Deprivation of Liberty Safeguards (DoLS) are part of the Mental Capacity Act 2005. They aim to make sure that people in care homes, hospitals and supported living are looked after in a way that does not inappropriately restrict their freedom.
